Del genocidio por goteo al genocidio por diluvio: la fase avanzada de la selectividad jurídico-penal
Abstract
This article examines the validity of the criminological critique of our ethno-landscape, focusing on the transversal characteristics of punitive power, as well as its violent operation. It is observed that homicides of vul-nerable individuals no longer occur by drip, as previously argued, but have turned into a genocide by deluge, reaching unprecedented numbers within a criminal policy of the ‘other’ of neo-Lombrosian sort. The article highlights that we are witnessing an advanced phase of criminal selectivity, characterized by both the lethality of punitive power and mass incarceration framed within State policies. It argues for the necessary renewal of our critical approach, rejecting any form of criminology of blindness that obscures or neglects the current abyssal selectivity of punitive power. This critical renewal prioritizes racism as the central axis that sustains such selectivity, along with a careful examination of the role played by selective stereotypes in this phenomenon.
