Abstract

Punishment remains today as one of the focal studies within a so-cial structure, especially because from its application it is possible to create an overview of the problems, needs and conflicts that affect communities. The institutions in charge of exercising these sanctions aim to create solu-tions that are proportional to their challenges. However, on many occasions these efforts do not provide satisfactory or adequate answers. The opportunity to learn about two institutional models with opposing approaches invites a review of the possibilities of improving sanctioning methods. There in lies the relevance of the present comparative research article, which relates the strengths and points of improvement in the comparative criminal processes of Switzerland and Colombia, expressing the need to devise new solutions for the existing models.
