Acuerdos especiales del derecho internacional humanitario: una perspectiva integradora en el Acuerdo de Paz de La Habana
Abstract
International humanitarian law is one of the instruments that, along with international criminal law and international human rights law, is essential for limiting the effects of armed conflicts. Special agreements in non-international armed conflicts can expand the scope of application with new obligations that support humanitarian norms. These agreements allow for broader commitments than those contemplated in the Geneva Conventions. According to the icrc, a peace agreement can be considered a special humanitarian agreement, as mentioned in commentary 850 of common article 3. The 2016 Havana Agreements between the farc-ep and the Government of Colombia serve as an example, as they establish additional obligations to strengthen humanitarian mechanisms. These measures include the creation of an accountability system, the search for missing persons, and the “broadest possible amnesty”. Another measure introduced by the parties is the incorporation of these obligations into the do-mestic legal framework to ensure their enforcement.
