Abstract
Modern societies increasing reliance on new technologies has significantly impacted electoral processes, altering public discourse and access to information. This article explores a possible criminal legal approach to behaviors that represent voter deception through digital platforms and social networks, including those that today occur with the help of fake news and artificial intelligence. Specifically, it analyzes the possibility of addressing the damage caused by these conducts to the freedom of the voter through the crime of voter fraud and explores the tensions that such criminalization may represent for freedom of expression in the midst of the public-electoral debate.
