Horace McDonald and recreational use liability
Abstract
This thesis examines the scope of landowner immunity under the Kentucky Recreational Use Statute in the context of injuries arising from free recreational activities. Through the analysis of Horace McDonald’s case, it argues that stargazing constitutes a protected recreational use and that statutory immunity applies absent in willful or malicious conduct.
