Criticita della Carta delle Nazioni Unite e prassi degli organi principali nel mantenimento della pace e sicurezza internazionali
Abstract
At the eightieth anniversary of the UN, international peace and security are threatened by those States that breach or threaten to violate the fundamental norms of the Charter and, contrary to what has happened in the past, do not even attempt to justify those breaches. Is it possible to overcome, from the legal point of view and considering the institutional framework, violations of the principles of sovereign equality and non-discrimination, the real criticalities of the system? A good starting point would be to recognize that the main organs of the UN (beyond the Security Council) have the authority to ascertain the gravest breaches of international law, thus singling out the responsibilities even if those belong to the most powerful States
