Проблеми та перспективи правового регулювання платформної зайнятості як особливої форми реалізації права на працю у межах правового режиму Дія Сіті
Abstract
The article is dedicated to analyzing the transformation of labor and related legal regulation under the conditions of the gig economy’s development and the operation of the special legal regime, Diia City, in Ukraine. The relevance of the research is driven by the rapid spread of digital platforms and non-standard forms of employment, which significantly alter traditional perceptions of labor relations, social guarantees, and the distribution of risks between employers and performers. The paper examines current provisions of the Law of Ukraine «On Stimulation of the Development of the Digital Economy in Ukraine» from the perspective of compliance with European standards, particularly Regulation (EU) 2016/679 (GDPR). It is substantiated that the current legal regulation of personal data protection within the Diia City regime is predominantly referential in nature and does not adequately address the specifics of mass data processing, algorithmic management, and cross-border digital services. Based on that reasoning, the authors propose the introduction of a mandatory Data Protection Impact Assessment (DPIA) for Diia City residents as an instrument of preventive risk governance and as a necessary prerequisite for obtaining a decision of the European Commission on the adequacy of the level of personal data protection. Special attention has been paid to the issue of the lack of dedicated requirements for IT security and information security audits applicable to resident companies. The expediency of transitioning from purely financial and personnel control to a systemic cybersecurity audit, utilizing international standards ISO/IEC 27001 and NIST recommendations, is proven. The potential of institutionalized professional self-regulation as an additional mechanism for balancing the interests of the state, business, and specialists is also substantiated. It is concluded that the improvement of the Diia City legal regime in the proposed directions will contribute to increasing the level of protection of performers’ rights, strengthening digital security, and maintaining Ukraine’s investment attractiveness in the conditions of the global digital economy.
