Abstract

Administrative law still has a long way to go in the study of medical liability. In this regard, a comparative analysis of the various bases for attributing state medical liability is essential, as it provides valuable insights into understanding and evaluating the strengths and weaknesses of different liability regimes. In this context, a comparative law analysis of Colombia and Costa Rica – focusing on identifying and examining similarities and differences, as well as reviewing their constitutional and legal frameworks –, makes it possible to consolidate elements of judgment from which both legal systems can benefit and become stronger. Rather than merely identifying common patterns and distinctive elements, this paper analyzes them based on an understanding of the concept of the medical act in each legal system
