Abstract

This article analyzes the State’s liability within the Inter-American Human Rights System for violations of the non bis in idem guarantee and its impact on the Colombian legal order. To this end, it examines the foundations of this guarantee in the American Convention, as well as its development in jurisprudence of the Inter-American Court of Human Rights. The Court has gone beyond the literal text of the Convention to define the guarantee’s nature, conditions of application, and object of protection. The article also explores how these considerations have been incorporated into the Colombian context and concludes by highlighting the persistent difficulties in interpreting this principle at both the inter-American and domestic levels
